The Office of Liquor Gaming and Racing is seeking feedback on the NSW state government’s Three Strikes Disciplinary Scheme as part of a statutory review of the legislation.
According to OLGR, the review will seek to determine whether the aims of the scheme are still relevant and if the terms of the scheme remain appropriate.
The Scheme was introduced on 1 January 2012 and allows for ‘strikes’ to be incurred against a liquor license should a licensee or approved manager be found guilty of breaching a serious offence under the Liquor Act 2007.
Earlier this year, Erskinville’s Imperial Hotel was ordered to close twice due to numerous breaches of the Liquor Act and the licensee of Sydney CBD venue, Hotel Chambers received its first strike and was also fined $2,000 and ordered to pay $1,500 after pleading guilty to breaching the 1.30am lockout.
OLGR are interested in receiving opinions on both the positive and negative impacts of the scheme including financial and other business impacts, as well as impacts on venue practices and behaviour aimed at minimising the risk of incurring strikes.
Public submissions will close on 12 January, 2016.
