A Han’s Café franchisee in Mandurah, Perth, will back-pay 16 workers $27,086 after an investigation by the Fair Work Ombudsman.
Theo Jose Dominic Sayoco, Grace Bela-Ong Sayoco and the company T J D Sayoco Pty Ltd, trading as Hans Café Mandurah, have entered into a court-enforceable undertaking with the workplace regulator and will pay $2000 to the government’s Consolidated Revenue Fund.
Inspectors found 16 employees including waiters, kitchen attendants and two student visa holders were underpaid from September 2017 to March 2018.
Staff were paid between $16.39 and $19 per hour when they were entitled to $24.41 on weekdays, $29.30 on weekends and $48.83 on public holidays.
FWO Sandra Parker said the court-enforceable undertaking was appropriate as the venue admitted to breaching workplace laws, cooperated with the investigation and committed to back-pay affected staff by 7 October 2019. Underpayments per staff member ranged from $30 to $3290.
“The company will improve its payroll process and undertake external audits to ensure that staff are receiving their correct entitlements, which will particularly benefit young or migrant workers who are unaware of their rights at work,” said Parker.
Fair Work says they will continue to take enforcement action to ensure workers receive their entitlements.
