The operator of a Gold Coast restaurant is facing court for underpaying three employees.
The Fair Work Ombudsman has commenced legal action against WS Natural Food Pty Ltd, which operates Sogongdong Tofu House, and the company’s sole director Seouk Woong Hong.
Three former employees requested assistance from the regulator and a Fair Work inspector found the workers had been underpaid. A compliance notice was issued in May.
It’s believed the workers, aged between 21-22, were underpaid their minimum wage rates, casual loadings and penalty rates for weekend and public holiday for short periods of work between June and October 2019.
The company failed to back-pay the workers and will appear in the Federal Circuit Court in Brisbane on 19 November.
WS Natural Food Pty Ltd faces a maximum penalty of $31,500 and Hong faces a penalty up to $6,300.
The Ombudsman is seeking an order for the company to rectify any underpayments in full plus superannuation and interest.
